Supreme Justice Holmes said in many cases he found for people he "despised." In other words, he decided on the law and the facts of the case, as the Constitution requires. With Judge Sonia Sotomayor, it seems it's always a matter of black and white, or brown and white or yellow and white. Guess who wins?

In the Ricci case, a dyslexic white public safey official who spent about 1,000 hours studying for his exam, spent money to hire a reader to help him and scored well enough to qualify for promotion was denied promotion when the New Haven bureaucracy threw out the exam results because no blacks reached the qualifying level. Sotomayor and two other judges didn't have the courage to write an opinion, but only issued a short statement rubber stamping the district court's upholding of the bureaucrats' outrageous action. Mr. Ricci appealed the case to the Supreme Court. It will be astonishing if the Court does not rule he was denied his constitutional rights. This is what some call "racialism" which in fact is nothing but "racism.'
